New York health insurance attorney Mark Scherzer was recently interviewed by ABC News in relation to the denial of coverage by United Healthcare of a young woman's claim for lifesaving treatment of her rare medical condition. Although New York's external review program (which provides reconsideration of medical claims by independent physicians) frequently results in reversals of improper health insurance claim denials, external review in this case reaffirmed United Healthcare's decision. However, after reviewing the documentation concerning the young woman's claim Mr. Scherzer determined that the claim was improperly classified by the external review program, and that had the claim been correctly classified, external review would likely have overturned United Healthcare's denial of coverage and resulted in approval of the treatment.
This case underscores that if a person has received a health, life or disability claim denial, it can be extremely beneficial to consult with an attorney before filing the appeal to maximize the probability that the claim will be approved.
